Screenings & Background Checks Made Easy

  · ESS Home / FCRA Compliance

To comply with the Fair Credit Reporting Act (FCRA), Drivers Privacy Protection Act (DPPA), and Gramm-Leach-Bliley Act (GLBA) if you are performing an employment, tenant/buyer, or volunteer screening you must disclose to your respective applicants in writing that a background check will be done, get their written authorization allowing you to do so and keep their signed waiver on file a minimum of five years (check all local, state, federal or international laws, or regulations, for requirements), as well as acknowledge that you will not use the information obtained in violation of any applicable local, state, federal or international law, or regulation.

Should you choose to deny anyone employment, residency, or a volunteer opportunity based on anything found in the screening report you must notify them in writing the reasons for the denial, provide them with a copy of the report, let them know the decision did not come from the consumer reporting agency or ESS and allow them the opportunity to correct any incomplete or inaccurate information. Please consult your attorney to ensure FCRA compliance and compliance with all other applicable local, state, federal and international laws, and regulations.
